Designated agent details, required information, and counter-notice procedure under 17 U.S.C. § 512.

Milk & Ink Studio LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page explains how copyright owners can submit takedown notices and how users can submit counter-notices.

1. Designated agent

Notices of alleged copyright infringement must be sent to our designated agent:

We register our designated agent with the U.S. Copyright Office under 17 U.S.C. § 512(c)(2). The current registration is searchable at copyright.gov/dmca-directory.

2. What a takedown notice must include

Under 17 U.S.C. § 512(c)(3), a valid takedown notice must include all of the following:

  • (a) A physical or electronic signature of the copyright owner or person authorized to act on the owner's behalf.
  • (b) Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
  • (c) Identification of the material that is claimed to be infringing — including a URL or other information sufficient for us to locate the material on the Service.
  • (d) Your contact information: name, address, telephone number, and email.
  • (e) A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • (f) A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices missing any of (a)–(f) may be rejected as non-compliant. We are not required to act on non-compliant notices, but we may notify you of what's missing.

3. False claims

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages, costs, and attorneys' fees incurred by the alleged infringer, by any copyright owner, and by Milk & Ink. Send notices in good faith.

4. What we do when we receive a valid notice

We will:

  • Remove or disable access to the allegedly infringing material;
  • Notify the user who posted the material that it has been removed;
  • Provide that user with a copy of the notice (with your contact information) so they can submit a counter-notice if they choose;
  • Terminate accounts of repeat infringers per our Terms of Service.

5. Counter-notice procedure

If you believe material was removed in error or as a result of misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). It must include:

  • (a) Your physical or electronic signature.
  • (b) Identification of the material that was removed and the location it appeared before removal.
  • (c) A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  • (d) Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the U.S. District Court for your judicial district (or, if outside the U.S., for the Southern District of Indiana), and that you will accept service of process from the original complainant.

Counter-notices go to the same designated agent at dmca@milkink.studio. On receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed material.

6. Repeat infringer policy

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We track the number of valid takedown notices per account and apply this policy at our reasonable discretion.

7. Trademark and other IP complaints

For trademark, right-of-publicity, or other (non-copyright) IP complaints, email legal@milkink.studio with the same level of detail required for a DMCA notice (your identity, the right you claim, the specific content alleged to infringe, and your good-faith basis).
